La Corte tambi\u00e9n dej\u00f3 firme la absoluci\u00f3n por el delito de asociaci\u00f3n il\u00edcita, desestimando el recurso del Ministerio P\u00fablico por considerarlo \u201cinadmisible\u201d seg\u00fan el art\u00edculo 280 del C\u00f3digo Procesal Civil y Comercial.<\/p>\n\n\n\n<p>Seg\u00fan el fallo, \u201clas sentencias dictadas por los tribunales anteriores se asentaron en la profusa prueba producida\u201d, y se remarc\u00f3 que Cristina Kirchner \u201creleg\u00f3 la ventaja econ\u00f3mica para la administraci\u00f3n p\u00fablica por la ventaja econ\u00f3mica para intereses particulares\u201d. La condena incluye tambi\u00e9n al empresario L\u00e1zaro B\u00e1ez, al ex secretario de Obras P\u00fablicas Jos\u00e9 L\u00f3pez y otros ex funcionarios.<\/p>\n\n\n\n<p>En diciembre de 2022, el Tribunal Oral Federal 2 hab\u00eda sentenciado a Fern\u00e1ndez de Kirchner por administraci\u00f3n fraudulenta y ordenado el decomiso de $84.835 millones, al considerar probado un esquema que favoreci\u00f3 a las empresas de B\u00e1ez durante los gobiernos kirchneristas.<\/p>\n\n\n\n<p>La defensa de la ex presidenta plante\u00f3 numerosos cuestionamientos sobre la imparcialidad del tribunal y la valoraci\u00f3n de las pruebas, pero la Corte concluy\u00f3 que esos planteos no lograron demostrar arbitrariedad ni violaciones a garant\u00edas constitucionales.<\/p>\n\n\n\n<p>En sus fundamentos, la Corte rechaz\u00f3 los argumentos sobre supuesta parcialidad de los jueces y consider\u00f3 que las cr\u00edticas de la defensa fueron una \u201creedici\u00f3n\u201d de argumentos ya descartados por instancias inferiores. \u201cNo resulta una refutaci\u00f3n suficiente sostener un criterio interpretativo distinto\u201c, se\u00f1alaron los ministros.<\/p>\n\n\n\n<p>La decisi\u00f3n de la Corte agota las v\u00edas ordinarias de apelaci\u00f3n, dejando firme una condena hist\u00f3rica que sella un cap\u00edtulo central en la relaci\u00f3n entre el poder pol\u00edtico y la Justicia en la Argentina.
